The United Nations must “review Israel’s status as a law-abiding member of the United Nations” by declaring its “Occupation as illegal”, UN Human Rights Council Special Investigator, Michael Lynk, stated on Thursday. Such a move would help to force it to end the Occupation. Lynk was addressing a United Nations press conference in New York, where he proposed a get-tough strategy to force Israel to withdraw from the West Bank. “What if, Lynk asked, “the many forms of military, economic or academic co-operation with Israel would now end?” If that would come to pass, there would be a sea-change in Israel’s attitude toward the Palestinians, he said. Lynk was at the UN to push member states to formulate a resolution that would add strength to the international body's attempts to get Israel to respect international law. This would include a General Assembly resolution that asks the International Court of Justice at The Hague to issue a fresh advisory opinion confirming the illegality of the Israeli Occupation. The UN Human Rights Council's Special Investigator explained that there is a vast difference between a legal and an illegal military Occupation, particularly with regard to the application of UN sanctions. The International Court of Justice has already issued an advisory opinion confirming the illegality of Israel's annexation Wall in the West Bank and, as the Wall is an essential component of Israel's settlement and colonisation project, a precedent has already been set. Should Israel’s “occupation” be declared unlawful, the UN could consider making use of the Uniting for Peace resolution (General Assembly resolution 377A), which would give the GA the power to sanction Israel in the absence of a strategic consensus among the Security Council’s five permanent members: the US, UK, China, France and Russia. Michael Lynk is a Canadian legal expert who holds the post of Special Rapporteur on the situation of human rights in the Palestinian territories for the UN Human Rights Council. Khan al-Ahmar, home to 173 people, is located in Area C – the 60% of the West Bank that lies under full Israeli control. The village is home to one of 20 Jahalin Bedouin communities at risk of ethnic cleansing, due to Israeli settlement expansion. The Israeli construction plan for the area has been frozen since 2009, following international outrage. The communities under threat comprise 2,300 Palestinian refugees who had already been displaced by Israel in the 1950s. Plans for this area aim to link the Ma'ale Adumim Occupation settlement to Jerusalem, with the intention of breaking the contiguity of Occupied Palestinian territory. Abu Khamis, the mukhtar of Khan al-Ahmar, knows that his community has become a symbol of the Palestinian struggle to remain in their land. “There's proof this community has been here since 1967. We are only the first piece of the puzzle in the bigger picture”, Abu Khamis told Palestine Monitor. “If they relocate this community, they will relocate all other communities in the area”, he said, adding that he believes international pressure can help postpone the transfer – a strategy that has worked over the years, even though it leaves the community in a constant state of insecurity. Since 2009, residents of the nearby settlement of Kfar Adumim and the pro-settler organisation Regavim, have been filing petitions to demolish the Khan al-Ahmar Primary School, which serves 174 pupils, and evict all the villagers. The community's lawyer, Shlomo Lecker, says: “While the government argues that the residents of Khan al-Ahmar will receive alternative housing, they will in fact be evacuated against their will for the benefit of settlers, and placed above the garbage dump in Abu Dis.” B'Tselem said Israel was asking the High Court for “permission for commit a war crime. US Senate Bill S.720 drafted by the Israel lobby group, American Israel Public Affairs Committee (AIPAC), as part of its “2017 Lobbying Agenda” is set to punish any individual or company that boycotts Israel for its violation of Palestinian human rights. The severe punishment could reach a million dollars in fines, and up to 20 years in gaol.
